If you know where your horse is, and you know that law enforcement doesn't want to touch this case with a 10' pole, I say just go "steal" your horse back in broad daylight. Would probably be better if the guy wasn't home, but whatever...even if he is, what's he gonna do?
Call the Sheriff?
Even if the Sheriff did decide to show up this time, you've got all the documentation of what you've been trying to do for months now.. If he agrees and tells Mr. Uncle to back off, fantastic...if not, simply remind the Sheriff that it's a "civil matter" and that there's no horse thievery or anything else criminal going on...and that he's not needed. I mean, the Sheriff's apathy has basically ensured that you're covered either way.
Seriously...get a bunch of big guys together, get a video camera to record the whole thing, and go get your horse back. Once you're down the road with your horse, Mr. Uncle will be in the shoes you're in now...he can either try to recover the money he paid his nephew (...$0, I'm sure...) or muddle his way through courts and sheriffs and rangers and PI's and whatnot, just as you've done.
Or, he can try to steal the horse back again, in which case you get to shoot him.
