I also had a horse leased to a woman, legal contract which she breached, I gave her notice by certified mail of the breach, plus a cease and desist for the use and ask that she return him,
my contract also had a clause that she was not to move him from her premises.
She verbally thru an email said she would not bring himm back that I owed her money for training and board etc, even tho it was stated in the contract she could not encumber. lein etc said horse, also a clause that "IF" it was to be litigated it would be governed by NV. Law county of Washoe.
This all transpired in 2008, finally I had the Paint horse stallion returned to me by a person that had him, 2 years later!
We attempted to have him picked up by transport, that is when she said I owed her money and he was in Ore. at a fellow trainers, SAY WHAT?
I was hampered by the CA. sheriff office telling me she claimed she owned the horse thru abandonment, she had moved the horse supposedly to Ore., later a friend of mine and myself went to the local sheriffs office with all the paper work to prove ownership, Sgt. in charge refused to look at any paper work at all and said I was another OJ Simpson, they would not help me, we came back 600 miles with no horse, we did see him and right after that he was moved, we could not find him, until Jan 2010.
There are more particulars to this case, but I am not at liberty to discuss them at this time, I am the original breeder/owner of this stallion, he was foaled in 2000!
