Subway has gone off the deep end. Trying to patent a unit of measurement like "foot long". If a sandwich is a foot long its a foot long. What are people to do, make up a new unit of measurement so they don't offend a giant? I know if they keep it up I will not eat there again. I will go to the smaller shops and pay more.

From what I understand, you can't trademark or patent a common phrase or item. The foot long sub sandwich has been around since way before Subway came about. They probably won't be successful.

Yep foot long sandwiches can not be trademarked or patented however if one decided to use "Subway" or use something like "Subway imitation of sandwiches" I can see why the company would get upset.

well I work at subway and I hadn't heard of any of this, than again I am in Canada and the news story I just read was from the MSNBC website, here is a link for what it is worth. to me it all sounds rather childish to be fighting over something so ridiculous.

Sub sandwiches have been around since LONG before Subway. And the term is used by so many, many other restuarants that even if it hadn't, they would have lost the ability to claim exclusive use long ago.

I personally dislike Subway, but not nearly as much as Quiznos. I do like Blimpy.

Makes me think of when Donald Trump trademarked the phrase "You're fired". He's hardly the first person to say that and I find it ridiculous that he thinks he "owns" that phrase. Just stupid.
