Theif and Vandal! Thinks hes in the right? HA!

I'm having a real problem of the "probably illegals" and going forward with this sale. You might have broken the law just by going through with the contract and what do you want to bet they know it.

I agree, the house was theirs. They can do what they want with the personal property unless it was written in to the contract that they were a part of the house and not to be removed if you had to take it back.

Second Saddi you are so right. We own a house in my home town. It has been on the market now for 3 years. Our realotor has tried to get us to finance several people that were interested in the house. I said the same thing, if a bank won't give them $ than why would I?? I know there are circumstances beyond some peoples control. We are just not in the position to deal that way.
 
I went over the paperwork again and carefully checked the wording. (BTW he does list a proper SSN for himself but not one for his wife)
It states (in so many words) that the appliances and extras are a part of the house and property and are not to be removed unless for repair or to be replaced by a similar object of equal or greater value. .... At which point should the buyer foreclose or fail to fulfill the contract he is held accountable for any damages or loss of property within a substantial amount as deemed by the seller.

I sware ive read these papers a zillion times and everytime I catch something I should have worded better, but nonetheless the terms of the owner financing contract were clear. The contract was never fulfilled and the deed was never transferred.

I'm sorry to hear such horrible things happened to all of you! I guess I should be glad there is any house left at all! A sledgehammer... such horrible people...

My dad had a similar circumstance with a house he was buying in the next town over. I was only in HS back then and didn"t draw the contract for that one (if there even was one). He was asking for it on that house though. It was beautiful! Even nicer than that one, with a sunken living room, fireplace, stone kitchen walls with built in shelves, all hardwood floors, old english style bathroom... just beautiful!

We were living in it with his girlfriend and her 4 kids. When they split we moved out and he let her stay under a renters agreement (yea, tell me that wasn't bound for disaster!). When he finally evicted her and we went to assess the damages it was in an even worse state than this house! they had obviously let animals live in there without much care for them. The carpets were so pee stained (Im sure some of it was human) you would have thought the original color was yellow! The walls looked as though they had been stabbed over and over (probably with an axe, I guess they didnt have a sledgehammer). We couldn't stay long because we were being attacked by hundreds of fleas. On the ride home we had to pull over on the highway, get out of the car and roll in the dirt because so many fleas had gotten on us and were just biting like crazy (id rather roll in the dirt on the side of the road then bring that home to my dogs!) So much damage it was cheaper for my dad to just let the house go and foreclose on it than to try and fix it up again.

Makes me kinda think of that show Repo Man. LOL!

Can I also ask. What is your training, education? In other words what are your qualifications to write a properly worded contract?


You got to kind of sit back and wonder just what do you plan on getting out of the vandal. Here is a guy, wife PG, young kid, and he ain't worried about keeping a roof over their heads. Obviously he ain't got any money.

Good luck having the terms of your contract enforced but I can almost bet the law in that town is going to tell you it is a civil matter. He broke the contract, not like he broke into the home and stole the ACs, the shed or the fence. Your contract allowed him access to the home, breaking that contract is a civil matter not something for law enforcement. The sheriff ain't in the business of enforcing your contract.
 
WELL GOOD NEWS!!!

Because this was a rent to own contract and the deed and everything was still in my father's name the police are going to press felony charges under grand theft larceny. in less then 24 hours a warrant will be issued for his arrest!

Finally the justice system pulls through!

You know I was once attacked with a beer bottle outside a bar in TX. The cops were inside the bar throwing people out. I walked back into the bar and grabbed an officer and they let the irate drunk get in their car and DRIVE away! They said, and i quote, "Unless an officer witnesses the incident, it's not considered assault."

I was like WUHHH?!?!?!

So it'll be nice to finally see the law down in that town do something RIGHT!
