thats what I said but he read the statute and it is as follows:

Each such domestic duck, goose, brant and swan before attaining the age of 4 weeks shall be marked by having the hind toe of the right foot removed, and no such duck, goose, brant or swan over 4 weeks of age, may be processed or sold without such mark.

I told him that my runners ant fly and are breed specifically for domestic use but he said its the law. He is looking into it further so maybe he will find a loop hole in it for me.

I asked him if i could fight it by submitting a request or something like that but he said no it was the law and that he did not think I could.

How crazy is this!!!

why cant I just tatoo, toe punch, or tag or band it I do not know.

I am sure one day they will and then if I have not complied with all the rules they can take my licence away and remove my birds.
 
You would think wing banding or leg banding would be a better way. Any predator in a pond could snip off a ducks toe.
I agree this is a dumb way to do this....
 
I dont even know how I would do it to my adults and how I could keep them from bleeding out or getting infections, not to mention the huge amout of stress it will cause them
 
I thought it was just native species that had to have this done...like if you were raising mallards and mallards were native to your region. No doubt the laws vary from state to state, but this sounds TOTALLY unnecessary for runners.
