Frankly I have silly ordanance laws I know they have there place in our system but frankly I prefer not being told what to do with my property. Soon I will move to a place where that is the case and I can do whatever I please.

I wish them luck I know how hard it is to think you cant have a few chickens when the people around you can have yappy dogs.

When I first got a few chickens, I went to the town and asked about a license/permit. The clerk say's to me; "Do what you want, nobody can stop you". At first I thought she had a typical town employee attitude, but then she explained when I let her know that I was trying to comply with local laws and it was her JOB to give me the information I was asking for.

Long story short, it turns out that there is a woman in my town that applied for a permit. The permit says you can keep up to 25 PLUS up to 3 roo's. She was granted a permit and about 4 months later the complaints came flooding in from neighbors. Code enforcement went out there to inspect and found the birds in horrible conditions. No water, rotten feed, DEAD birds that were rotting on the ground and the smell was enough to make you gag. They had a lean to for shelter and minimal fence for protection.

The code guy gives her 5 days to bring up the standards of the birds area. He returns 7 days later and NOTHING had been changed. He revokes her permit and tells her he will be back to remove the chickens. Well, come to find out - there is NOTHING on the books that allows the town to enforce the "chicken regulations". The owner and town got lawyers involved, there was meetings but in the end, the town was completely powerless to do anything about it. The "codes" were written back when people were raised with chickens and enforcement was not a problem. There was talk of rewriting the codes but there is nobody to enforce them with budget cuts.

So thats why she said "Do what you want, nobody can stop you". I told her to remember my face if the town starts being proactive and goes after people that dont have a permit. Remember that I was here and I tried to do the right thing. She agreed and laughed. (i'm pretty ugly, so im sure she will remember me lol)

I asked about having them removed as being a health hazard but she said the town "doesnt want to go down that road" because of the time/expense with legal issues and all. Its a shame that people cant do the honorable thing and properly care for their birds. The license is only $5.00 for the year!! Now im hoping that I didnt make them revisit the codes and RAISE the fee to $50.00 and hire an enforcement officer! (but if they do, im applying for the job!)

ETA: i didn't even check to see if i could have ducks where i live, but my dad said because this is "dairy land" even though we live on a 15 year old housing track.. he wants mallards now so i am on the hunt
