Uh oh, a roo?

A roo easter egger? 10 weeks old or so. Supposedly the neighbors property deeds a say no roosters. Bird in question is the primarily orange one

The tail feather allow me to understand why you think cockerel but the comb seems to be smaller than the one it is standing next to. If they are the same breed I would say pullet. I sex by comparing chickens of the same age and breed together using combs usually I am fairly accurate (with brahmas anyway)

It's too young to tell by its hackle feathers and Easter eggers generally grow longer tails even as females.
