Update: my "welsummer" is approaching 6 months old, still have no idea about gender.

The first picture is about 5 months, and the second is roughly 6. I bought it at 3 months...thinking I bought a hen (it was labeled as one). I'm guessing its not. I have no egg to prove anything nor, have I heard crowing.

sigh. nevertheless its a really pretty chicken.
 
That's a cockeral. At three months most reasonably experienced folks would have known the gender, so I'd contact the seller and see if they will make it right for you.
 
It's very easy to tell a male from a female welsummer, even at 3 months. The seller must be new to the breed if they weren't able to. Go back to them, if you can, and see what they'll do for you.
 
do a search for a welsummer hen and the wesummer rooster and you will see that no way was your chicken mistaken for a hen by someone who knows welsummer chickens. I think someone may have decieved you on purpose if they said this was a pullet at 3 months age. by the time he was 2 months old a person who knew welsummers would have known he was a HE.
