UPS broke my Dickey Hatcher. Dial up warning FINAL UPDATE pg 11

That is what happened to me. I shipped some glass pieces that I had carefully wrapped in bubble wrap, etc. Well, some pieces still got broken. The UPS people said my packaging was not sufficient and refused to pay the claim. I immediately refunded the buyer (on ebay) everything, including shipping charges, because it wasn't her fault that UPS handles their packages the way they do. It turned into an expensive lesson for me, but now I know that if I'm going to ship something fragile with UPS, it pays for them to pack it.

the OP stated that the box was cut to just fit the contents..
 
It looks very fixable to me. I didn't realize that these things were just plywood. One could be built for a fraction of what they get for them new.

There was no cushioning at all. The hatcher was put into a box that was cut to fit the exact size of the hatcher then taped together.
So unfortunately when it was knocked/dropped whatever UPS did there was nothing but the cardboard box to protect the outside.

I have spoken to USP and just sent them 13 photos but have a horrible gut feeling that based on the way it was shipped that they are going to put it back on the seller.

Well the update is there is NO update. I have called UPS and they will only deal with the shipper, now telling me that any refund will go to the shipper and it is up to the shipper to refund me for the damage. They will not discuss the insurance claim with me at all.

The shipper has been in contact with UPS who are giving her the run around and tell her she will be contacted by someone in 2 days, then yep no call! She did find out that their insurance claims were outsourced to a company in TX and is trying to get in touch with the gentleman in charge of the claim.

It's been 2 weeks this Thursday and UPS has been worthless. So I'm the sap who has a broken hatcher sitting in my basement, waiting to find out what is going to be done about it.
 
if this is the case, then you have to put pressure on your seller..

get him to reimburse you and let him fight it out with UPS..

he has his money, so there is no incentive for him to fight for yours.

Your contract was with him, not UPS.. and UPS has told you so, in a round-about way..
 
I have a question too, is it something so horrible that Mr. Dickey cannot replace the broken pieces and have it up and running. Did the internals totally die or just come unlatched from the cabinet. It is just a thought. Since both parties are BYC'ers, it might be good to get the insurance settlement and just fix the Dickey with that money so no hard feelings on either side.

Just a thought worth checking into.

If it can be fixed it would at least need a new door, hinges and some internal parts. BUT the problem is the outside is quite damaged with split wood on 4 sides and a grease like substance on it. The resale value for me would be next to nothing if I ever wanted to sell it. Even if it could be fixed the amount of external damage is such that nobobdy would pay anything near for it what I did.
 
It is their responsibility as the seller to refund your purchase price and go after UPS for the refund from the insurance claim for themself to get reimbursed. This is how it works when you ship something and insure it. The seller takes care of filing the claim and refunding the payment to the buyer. I've done it many times for folks.
