UPS broke my Dickey Hatcher. Dial up warning FINAL UPDATE pg 11

I just went ahead and filed a paypal dispute. The seller made it clear they were not going to refund me and it was up to UPS to do that. Being that I am too darn nice ( and stupid ) I didn't even ask to be refunded the cost of shipping ($85), just the $275 I paid for it, which was what the seller insured it for.

Thanks for all the support and suggestions. Will keep everyone posted.
 
I think I read some thing on here saying it has been 2 weeks already.. That is if I read every thing right..

File a report with paypal.. You can send them pictures of what it looked like.. Give them complete written details on how it arrived.. Paypal will look at the auction listing and read it and look at the before pictures..

File soon.. There is a time limit for that.. Dont wait on the seller.. They may make you wait till you can not file the paypal claim any more..

Just got an email from the seller. UPS is refusing the claim saying it wasn't packaged correctly and will not refund any money at all.

The seller has told me to reship it Fed Ex back to her and she will refund my money. ( I am guessing this does not include original shipping ). I've emailed her back to let her know I cannot afford to ship it back to her (and that's no lie). I am already out of pocked over $350.

I do believe I read some where that the UPS will not deal with you and only deal with the seller.. And the seller said that they will not refund the money.. If the UPS will not deal with you.. How do you know for sure that is what the UPS really told the seller..

I would still keep the paypal dispute going.. Although paypal will most likely make you ship it back before you get a refund.. But if paypal does make you ship it back.. At least you know you will get your money back...

The seller is at fault this time for not packaging it safely. Should have shipped as if they would like to recieve it.. I wouldnt leave feedback until after the paypal dispute is over though..

The problem is it will cost over $100 to ship it back. So if the seller does refund me the cost of the incubator I am still out the cost of shipping X2. Not to mention this thing is huge and I have nothing to pack it in to ship it back to her. I will have to buy a box and packing materials.

I lose either way.
