What Breed and Roo or Hen?

My daughter is away at college, living in a small town in east Texas. Her roommates found a chicken in the median of the highway and after driving by it for 2 days, stopped and brought it home. That is the extent of the history I know. It doesn't crow or lay eggs, but we don't know how old the bird is or even what breed. If it's a hen, then she gets to live life in the suburbs in my backyard. If it's a rooster we need to find a home because my town won't allow roosters.

I'm guessing New Hampshire Red, but I have no clue! Any assistance would be greatly appreciated!

FYI - the egg in this picture isn't real, but this picture shows the tail. I was visiting this weekend and the chicken has 2 black feathers still, nothing more. No crowing while I was there, no eggs either, but who knows how old this bird is. Thanks!

I would say at least a 6 months old and it is definitely a cockerel

What's going on with its eye in first pic. Something with how pic turned out or is it blind in that eye?

I'm wondering about the eye also - looks like it got injured and may be blind. Looks like a cockerel to me.
