You bet! If the township is hassling you, get in touch with your state representative. There was a BYCer that was being threatened by the township (court proceedings, fines, seizure of animals). He/she called the state rep. A meeting was had between the state rep, township official, and BYCer. The township never brought it up again.

Well, I keep reading this ACT but can not seem to get a clear understanding if I am in my rights or not.
6) Beginning June 1, 2000, except as otherwise provided in this section, it is the express legislative intent
that this act preempt any local ordinance, regulation, or resolution that purports to extend or revise in any
manner the provisions of this act or generally accepted agricultural and management practices developed
under this act. Except as otherwise provided in this section, a local unit of government shall not enact,
maintain, or enforce an ordinance, regulation, or resolution that conflicts in any manner with this act or
generally accepted agricultural and management practices developed under this act.

what does this mean.... "except as otherwise provided in this section" I don't see anything else in section 6?

I want to have chickens to produce eggs to sell... from what I read I should be allowed to do this... but how much is going to cost me to have this right?

It's just the terminology that is confusing you. The entire page is the Section, paragraph (6) is the subsection, and the "except as otherwise provided in this section" is a reference to subsection (7) which gives local governments the right to adopt standards different from the GAAMPs for the purposes of protecting public health or the environment.

How much will it cost? Hard to say. It depends on whether or not the local unit of government wants to fight you, and to what extent.

You can counter-sue for all your attorney and court costs. And toss in a request for punative damages as well if they have tried to strong-arm you.

Track your expenses and your profits, sell a few eggs a year you are now a "breeder" for all purposes. Now don't forget to file this on a schedule C so you have a paper trail. (I have a dear friend we "sell" each other 1 dozen eggs each year, and I now have a trackable business.

Good idea.

Just one little correction -- agricultural income and expenses are reported on Schedule F, the farm income and expenses reporting schedule for the 1040 (not C, which is for non-farm business income/expenses).
