What if a farm name is already taken?

We are going to be moving soon. We've been here for three years, and we call our farm Nails Creek Farm because the creek that runs through it is called Nails Creek. When we move, it won't really make sense to have the same farm name.
I've thought of a few that I like a lot, but they are all already taken. Some have many farms with that name. Is it okay to use it too???

Depends on the purpose of the farm, I suppose. Many farmers use the farm name like a brand, as in "Cocklebur Farm Fresh Eggs" and might not appreciate the intrusion on their brand name, if they are nearby. If the other farm with the same name is on the other side of the country, or if they are a hobby farm using their farm more for personal reasons than commercialization, then I don't see any problem.

For example, my house was built by a locally-famous historical guy named Newton (a relative of Sir Isaac), so it's the Newton House whether I like it or not; since it is also a farm by local standards (has a barn, chickens, turkeys, fruit trees and veggies), it's the Newton House Farm. There is another Newton House Farm, but it's in the UK and keeps horses, so we're not easily confused.

Only problem will be if both become famous, whoever has it documented as THIER name first, and gets a good Lawyer to prove that you are infringeing on thier Property rights.

 

[Rusty Hills Farm]

I'm sure there are others who call themselves Rusty Hills Farm, but I am the only one incorporated in the state of Alabama. If you want to own the name, consider incorporating it.
