That's a rooster. The well defined pink comb, the stance, the thick legs, and the appearance of the feathers around the tail say it all. Some roos take a long time to crow(I have one that didn't crow until it was over 20 weeks), so this shouldn't be used as a way to sex the bird.

My EE roo is multicolored and his comb is just like that (more red tho lol) the second is totally a hen mine looks just like that too!

That's a cockerel... seen enough EE roos to say that with that comb at 13 weeks and the legs, stance and tail area it a roo. Some don't crow until much later.
