Don't move your hogs yet, call 1800 attorneys and run it by them,, consultation is free and they even have pro-bono attorneys, if the bank owed the land and didn't disclose the information, I don't think you have to worry cause the bank would have run a search on it, if you used a realtor contact them, or contact the bank, if no realtor was involved, and I bet it comes down to the can smell the hogs.
I think the deed was in the paperwork, we just weren't careful enough.
Is he actively selling his place?
Not yet, but he did say that they were looking at a place in Florida and stated that they wanted to sell in the near future.

You should ask if he would consider removing the deed upon sale. As long as he is not mentioning it in his sales pitch and/or paperwork on his place it shouldn't matter.

If it was in the paperwork you become a cautionary tale for others ... you really do need to read everything that is given to you prior to closing.

Fortunately he is at least being good about the chickens.

I agree, I'd ask too! And I personally would have no problem moving something bigger and "messy" like hogs for someone showing their property. It would just be nice to be able to move it BACK, afterward.
 
So the eBay BBS Cochin eggs went into lockdown tonight. I will be SHOCKED if anything comes outta those. I mean, they're still alive, but from the looks of the dang busted-up air cells I don't see how ANYTHING could grow to term in there.

But I guess we shall see. Just seems like awfully small babies in there when I candle.

Yes, at least he was nice about the chickens. And it was our problem with the paperwork. But if the new buyers our real country folk, maybe they will get chickens and be more tolerable about our animals. And I am just fine with moving the hogs but I don't think we will sell them, just keep them in a different place.

You need to go to the courthouse and get a copy of the recorded deeds. If that clause is in the recorded deed then it sticks to the property until the 60 years is up.
If the bank did not disclose that to you, then the bank was wrong in their handling of the transaction.
 
Almost, I slipped the babies I had under two broody moms that have hatched some already, the one took them like wow I have lots of babies and the other took some but then rejected 2 so they had to go under the other one. So now no babies that I have to care for!!!! The one broody mom couldn't get her kids to go out of the brooder box, so maybe tomorrow she will be able to since she has some older ones to show the younger ones. She is so protective of her babies another hen came by to look and mom really got aggressive and sent her packing. I love watching mommas and babies.
 
He gave us the copies of some documents that he had gotten at the courthouse. They were signed by him, a witness, and a notary. Can't argue much with that. We may just move the hogs to one of our friends places until our neighbor sells the land and a hopefully country lovin' animal lovin' buyer moves in.


This has already been said, but if its not recorded at the courthouse, it doesn't matter. Also, since he's said "ok on chickens" you need that in writing,

I also think that even if it actually is in the deed, the attorney who closed the ssle when you bought should have listed any special restrictions in the disclosure statement, and if its not there, you may have recourse against them for failing to disclose it
