Whip a small claims suit on her for five k. I know it is not what you paid, but it is the most you can ask for with the least amount of cost and trouble. See if there is any way you can sue her for two different things for five k each. Heck if you can find three sue her three times for three different things. It will give the judge three different chances to punish her. You can't get punitive damages in small claims. just acutal cost/losses which must be documented. You could sue her for future lost earnings maybe, in addition to your lost foal purchase price.
 
Yeah I will definitely do small claims if I find she's not in violation of the contract, yet still failed to provide what was needed. Probably thought if I do anything I'll make it a big case, in the contract she has to pay my lawyer fees, and I am sure her state has a few good sharks. I am really starting to get irritated by this run around nonsense.
 
You are making me so nervous! Just get the baby first. A regular micrchip is a good idear. Its a positive I.D. on the foal. Call her make nice, get your baby and come down w 2 feet. I would have it all done in front of your transporter too. oooooh! this just makes me so angry!! When she got her seman she did not know all the rules to the registration. Now she is kinda busted. Smile be nice get your baby then kick butt!!! This baby could be really nice!

I've heard breeders rave about the quality of their foals and they know full well when they are full grown they are not to breed standards. I wouldn't listen to much too her, she is already dishonest, so her word is worth nothing.
But if she did, (for absolute sure), breed those two then the chances are the foal is of good quality.

All correspondence with her should be in email or registered letters, you need a paper trail.

As for small claims court. I am not sure if the foal's breeder is in the same State as you but doesn't different States have different limits on what you can file for in small claims? If so I go with the higher amount.

I wonder who has bought the other foals? and what problems they are going through?

I am in contact with the only other buyer out of this years foals, and she had the same issues I did. Really hard to contact her, cant get full answers to questions. No pictures, no updates... the only call she finally got with any real update was one at work from the breeder letting her know that her foal dropped dead. Come to find out that mare had a foal the year previous with the heart issue, and this other buyers foal had a broken neck- but also a tear in the heart that might have caused it to fall during cardiac arrest and break its neck. Or the tear might have just been there and it fell on accident. But the breeder mentioned the other foal casually and said "well, i'll breed that mare one more time I guess and see how that one goes". It is just hear-say through another person, but I was really shocked to hear that.

I know the breeding definitely took place to Anne 340 for the mare who's foal I bought, that is the only record Fhana has, but it at least tells me that much. Well, they also have the certification that she made STER last fall as I was assuerd by the breeder- however she wont allow me to have a copy of it because I suggested her business skills were lacking due to no communication and no updates.

Lots of good info. They are an extremely reputable source for equine DNA testing. They do all AQHA's mandatory testing, so their results will hold up in a court of law, should things ever go that far. Have them send a local vet their kit and that way you cannot be accused of tampering with the test in any way. It will go from the vet to UC-Davis and the results back to you and/or the vet.

The test can be done from hair, so it is really simple to do.

Edited to add that DNA testing can be used to prove that the foal is not from the mare it's supposed to be from and is or is not from the sire. Either scenario can be used later--much later--to prove to the breed club what happened and hopefully help them ban her from ever using their registry again. Then no reputable Friesian stud owner will likely deal with her again and at least you'll have THAT satisfaction.

Winning is great but does not mean you will see any money. The old saying "you can't get blood from a turnip."

I think I am going to forgo the out sourced DNA testing right now, but I am about 90% sure that I'll call a local vet and have a regular old chip put in the foal before its shipped.

I will definitely put up pictures if I can get my retarded camera to work. We've over used it since our son was born, and it was recently dropped in the ocean and so only works intermitently.
