Anyone well versed in workmans comp. laws?

Kat what happens in WC cases is classic in every state in this nation: They go to the WC doc, the doc refers them out, the specialist orders treatment, and then more PT, then the first doc says, nope more PT, refer to another specialist and it is a vicious circle. The longer they can drag his case out the more money they get.

How does your DH feel? Is he still in pain? Is he functioning? Maybe desk job part time. If he feels in any way like he wants to go back, make him PUSH the docs relentlessly. He could be on this WC for years. I just got done with WC seminar this morning and closed the deal on our policy yesterday. I believe it is legalized extorsion.

DH had one from a knee injury at work, and he used our family doctor who referred him to the orthopedic surgeon. Sometimes those company doctors are not for the best interest of the patient, if you get my drift.
 
Let's just say I am very unhappy camper right now. Too ticked off for words. It bugs me that DH is so trusting of people, especially the so-and-sos at work. He's not listening to anything I have to say right now. He's hearing me, just not listening.
I do need to point out that the WC's nurse has been in our corner from the start. She's the main one that is pushing to keep DH on workmans comp. because she says she is fearful of what could happen to him on the job while on two blood thinners.
 
Kat, your husband needs to understand that this issue does NOT just involve him. You are directly affected by his actions regarding this case. Reluctant to LET you go with him? Oh hell to the NO. He doesn't need to carry the tape recorder, you should. I understand non-confrontational people, but this is horse hockypucks. He didn't do anything wrong, so why should he lay down and roll over ? As I said, this will affect YOU as well as him-----for the rest of your lives. He should put his reluctance to the side.

Well I'll tell you the outcome. It wasn't as bad as we thought, but I still think it's worse than DH does.

As usual the good ol' boys at city hall made it into more than it really was, just cuz they like *expletive* with people.
They presented DH with a letter saying that as of today he is on the FMLA (family medical leave act). This means he has three months to get back to work or he can be fired and their butts are covered.
DH said that both the chief and the mayor were going on and on about how much they missed him and needed him back. Basically blowing sunshine up his *another expletive*. I'm like, yeah right! They can't stand my DH because #1. he's a by the book cop - doesn't cut people a break just cuz they are related to someone in authority. #2 because he has seniority over every one of them. In fact, he trained the chief when the chief was a rookie. And #3 and most importantly, he doesn't buy into their politics. About ten years ago a very corrupt man was hired as mayor in the town. At that time a police chief that my DH thought quite alot of was fired, no reason, just fired. DH was very outspoken at that time about what he thought of the new mayor and how they treated the chief. DH was told at that time that because of his beliefs he would never rise above the rank of sgt. and he hasn't. Turns out DH was right and everyone else at city hall was wrong. That great mayor of theirs embezzled hundreds of thousands of dollars from the city and left town in disgrace. Then a buddy of that man was elected mayor.
They been looking for an excuse to get rid of DH ever since the new administration took office.

So, DH has three months to get back to work or lose his job. DH doesn't see that as a problem, but I do. What if he can't get back to work by then?

What I'd love him to do is this. Go back to work, work one day and at the end of the day give his two week notice that he plans to retire. I'm tired of the BS that job throws on him.
 
what, unless the laws have changed as long as he's on workmans comp they can't make him go on fmla. my advice is to go speak to an attorney I agree about 2 weeks thing if the attorney doesn't work. he was hurt on the job,all they want you to discover their own butts. they should not be allowed to force him to go on fmla I would look it up in speak to an attorney just my opinion.
