Anyone well versed in workmans comp. laws?

I thing you need an lawyer. Here is a good website I found....

What is interesting is that the allow you to go on FMLA is 12 weeks annually....so if he goes on Oct 1, and has holidays for Christmas and Thanksgiving, that takes him to New Year's Day, which if I understand correctly starts a new year and a new 12 weeks.

I do think you need a lawyer to clarify these things. And as I understand it, even if he takes his FMLA, if the WC is still needed, they still have to hold his job.
 
I am in the UK so have no words of wisdom based on knowledge other than do not accept anything that does not cover all medical costs for the rest of your husbands life and consult a lawyer who knows the law etc where you are.

Grits – you find a WC lawyer (or two), call and see if they have a free consult (most do). Make an appointment for a time you know DH has free.

Tell DH that you have an appointment and are going to get some legal answers – he is welcome to join you, but you don’t require him to. Write down all your questions and gather pertinent papers And then go.


Hopefully he will accompany you.

Gritty.. do NOT let him sign onto FMLA... stay with WC...
What if more problems crop up with his leg and stuff?? He wont be covered if he lets them take him off of WC..
 
Kat, are there more than 50 employees at that podunk department? Because if there are not, they CANNOT slap the FMLA on him, because they don't fall under the law with less than 50 employees. I think you REALLY need to call an attorney at this point.

He did talk to his WC adjuster today and she said that the FMLA has no bearing on his workman's comp., as far as continuing to get his WC checks and all. He will continue to be on WC, with them responsible for his medical bills,etc., until the doctor releases him. The city has the right to use the FMLA to cover their butts.
We expect him to be back to work within a month, so that will null and void FMLA anyhow.
