Are hawks protected in Florida? Yes, both federal and state laws in Florida provide legal protection for hawks. The 1918 Migratory Bird Treaty Act (MBTA) forbids hawks and other migratory birds from being pursued, hunted, taken, captured, killed, or sold without the required permission. All native hawk species in Florida are covered by this federal protection, including the red-shouldered hawk, which is widely distributed throughout the state.
