I want to know what other people would do if put in a situation where you had to sell to someone who had been convicted of animal cruelty in the past. Would you or wouldn't you?

Would you uphold your contract or would you suffer the consequences of your actions and NOT sell?

Well, I've been known to see a place and turn around and take my animals home. I take pride in my animals and expect others to do the same. Photograph the conditions of the affected animals and report the abuser to the authorities.

What kind of contract are you talking about? Verbal? Written? Either way include a clause about the conditions you expect your animals to be kept in.

I wouldn't. No, definitely not! In fact, my mother was a Doberman breeder and we once had this issue. She found out that they had issues in the past of dog fighting and rejected the sale of a puppy. The didn't fight her on it, but I can imagine had they that she would have told them where to go. Many people who sale animals protect the sale of animal from potential harm and I would think that you would be well in your right to do so. The sale isn't final until things are signed... I guess it depends on what stage of the sale you are in but either way I am sure you could fight it.

This is on an auction site....after the auction was over I didn't hear from the winner and then just by chance decided to do some research on the person....boy....what I found out would curl your toes. Now, I'm stuck with the auction being legally binding! Sucks!

Hopefully your buyer doesn't respond.

I'd get in touch with the auction site and see what your options are considering the circumstances. Maybe you can check to see if the buyer is even allowed to possess animals. Contact the local authorities and check further on how the case has progressed.

I 'repossessed' due to finding out my roos were intended on being used for fighting.

Stay tough and check all options!!

No, you do not. I always reserve the right to refuse to sell to anyone for any reason I deem appropriate. They're your birds, under your care and protection. I've even included that line in my ads to cover myself.

Forgive me for being obtuse here, but I don't understand why this issue would even come up? Animal cruelty is against the law, laws that have been on the book for a lot longer than the auction you are involved with, I'm sure. I agree with Desert Springs, contact the auction site, report him as a 'no show' and let them know the information you have found out about this person. Ask for him to be banned from future auctions. Nicely remind them if an animal cruelty case is ever brought up involving this person, the birds will be traced back to their auction site. Bad press, bad Ju-Ju.

Well said Haunted!!

Unless you have accepted the money, if you have, the birds are that persons, if you have not, they are yours, but you may owe money to the auction, even if you chose to no sale.
