About the eggs:

When you bought the eggs, did the seller have a disclaimer in their ad saying they were not responsible for how USPS treats the eggs? I bet they did.

When you contacted the seller, did they offer to replace the eggs for cost of shipping? I seem to remember they did---THIS is standard practice with shipped eggs. Cost of shipping is a pass-through cost to the buyer--NOT the seller's responsibility. You wanted the eggs, you need to pay for shipping--just as if you had to drive to pick them up, you would need to pay for gas. If they offered to replace the product for free, the seller is doing what they should.


The seller has a right to sue whomever they want. They probably won't since it would cost too much. HOWEVER, if you dispute thruogh paypal rather than setttling the issue directly with the seller, you could be pushing the bounds of fraud. You paid the money with the expectation they would ship you eggs. They did, and you recieved them. The seller made a good-faith effort to right the wrong. Refusing to pay could hurt their livelihood, (by screwing with their ebay %s) and they have the right to sue.

I agree - filing a lawsuit over your complaint/dispute would be way more expensive than fixing the wrong they did by poorly packaging the eggs. They are telling you that they'll sue you to try to scare you out of doing it - this, IMO, also means that you aren't the first person that's had a complaint & broken eggs. I would file the dispute & file negative feedback ... let them deal with the consequences of their actions.

But, the shipping will be on you; the new eggs will be on them - that is IF you want to trust them with shipping more eggs to you.

Yeah, I added that the shipping would be the buyer's responsibililty, not the seller's. That has been my experience - with anything I've bought online really.

After all this discussion about shipping eggs I decided to order some as well

. VERY excited! I'll let you know how it goes (in case you are working on the math: I have 20 adults, two Trader Joes chicks, 25 pips arriving next week from Sandhill and I will be ordering 40 eggs the end of April).

No end in sight. I'll order the book at amazon tomorrow: How to hypnotize your family so they won't notice a rapid increase in chickens.
