Not really because the statute says you have to have the coop 75 feet away from all residences. We have the coop on one side of the house next to neighbors that said they didn't mind and never complained. I explained that to animal control and he said it didn't matter. Even if the neighbors called in and said they didn't care the coop has to be 75 feet away and if a neighbor complains they have to go.

I was told by Animal Control today that a neighbor doesn't like my chickens so I have 2 months to get rid of them. I have a Black Copper Maran Rooster that is 21 weeks old, 2 Australorps, 2 Easter Eggers, 2 Rhode Island Reds 1 Barred Rock that are all 1 year old and laying great. I also have older hens Speckled Sussex, Silver Laced Wyandotte, barred rocks,rhode islands, golden sex link, Delaware. A couple of them are molting so may not look the prettiest right now but still good hens. I really need to find god homes for them. I would like to get $15.00 for each of the hens and $10.00 for the rooster. You can email me or text me at (480) 516-1306

I was reading the Mesa City Code 8-6-21 and it doesn't appear they have the authority to simply tell you that you have ten days to get rid of them. The only restriction I see says:

other than listed in this chapter and permission is hereby given to any such person to keep and maintain the same,
but only in the manner and upon the conditions set forth in this chapter. Such permission may be withdrawn by a
court of competent jurisdiction in the even a person is charged as a habitual offender in accordance with 8-6-11 and
found guilty of any offense listed in Article IV of this Title.
As you have not mentioned that you were taken to court and found guilty as a "habitual offender," I don't believe they can order you to do anything. They have to tell you what the problem is and give you the opportunity to resolve the situation. Just because a neighbor "doesn't like [your] chickens" does not mean they can violate your rights defined in the City Code. If they are loud, especially the rooster, definitely get rid of him. Otherwise, as long as the coop is within the defined codes and you don't have a nasty stench or fly problem, they can kiss off.

I watched Fiji, a full grown hen (she's my avatar - don't tell the others she is my favorite) eat a scorpion the other day....are you talking just the babies don't do well with scorpions or is Fiji just lucky?

Many times chickens will be faster than the scorpion and kill it before being stung. Any of them that get stung will become ill. Scorpion venom is a neuro-toxin.

wow I am so sorry.....is it a totally done deal or do you have any appeal rights? Have you read the statutes/code to see what it says for Mesa? Can you keep your hens (or some of them) and find a home for your roo?

The city code allows you 10 chickens if you live on less than 1/2 an acre. As long as you comply with the code. Not sure how a neighbor could cause a fuss unless it's in the CC&R's.

You may have up to 10 chickens on the first one-half acre or less provided any enclosure is at least 40 feet from any neighboring residence, any coop is at least 75 feet from any other residence, it is kept sanitary and they are not allowed to run loose or create a noise disturbance. A rooster is also allowed as long as it does not violate any of the above regulations. (See Mesa City Code 8-6-21.A, G, H, and I).

On some lots there's no spot that's 75 ft. from any residence and I think that's the problem.

The neighbor complained of feathers in her yard which is funny cuz everytime the wind blows the leaves and pods from her tree end up in my yard and pool. Anyway my coop is situated on the far east side of my house and that neighbor said he has no problem with the chickens but the officer said that it doesn't matter if the neighbor approves it still has to be 75 feet away from all neighbor residences. The whole issue is she is mostly ****** because the cats in the neighborhood poop in her yard and since I have 2 cats that have pooped in her yard she is taking vegeance on me. The really sad thing is she is hardly ever at this house because they spend most of their time in a cabin someplace else.
