Hey satay yep, I have my letter all penned and in the envelope ready to post.  I took photos and have witnesses who will verify that the car was not moved between the issuing of the infringement and taking of pictures.  

As you cannot request a review on line, you have to type, print and post the review request and colleagues have mentioned that they issue the infringements in the hopes that you will not be bothered to fight it and just pay it .. they picked the wrong person this time    If it was $40, I probably would do just that, pay it and get over it but I am not forking up $117 when I did not commit the alleged infringement.

I will let you know how I go.  Funnily enough, if they do waive it, I will be more cranky because that would just prove it was an attempt to gain revenue 

How far is the front of the car from the curb of that side street directly in front of it? Even though that has no gutter or footpath you will find the grass counts as footpath for a certain distance from the road. I'm guessing it's that technicality they are booking you on.

Hey appps, could be but it is not a side street, it is a driveway into a parking lot at the back of a building. The 'cover' under the front of the car is a Telstra one and even though it may look like the car is blocking it slightly, that is just the angle and it was easily accessible.



I have no idea why I got the infringement and yeah, it will be interesting to hear their response.

Make sure you put that in your letter, that it's not a road but a private driveway in case they look at the photos and think the same thing!

Actually it's illegal to park on a nature strip at all. Didn't know that.

If you are in front of the fence does that technically puts you on the nature strip?

Thanks appps, I really do appreciate the advice and input and as mentioned, very intrigued as to what they come back with.

I have mentioned in the letter ..... "In addition, I did not drive across a footway, water channel, or gutter (the latter two not found on the site as indicated above). When I arrived, to access the spot, I pulled into the driveway in front of my now parked car and then reversed onto the grass verge" .......

I also enclosed a picture of the property without cars parked in front of it, clearly showing driveways on either side of me.

Thanks again appps .. I did find some fine print on their site that does mention "Parking on a footpath or nature strip is prohibited" so you are probably right. However, still fighting it

Mainly because 1. Nature strip is not mentioned on the infringement, so I am still not guilty of what they have pinged me for. 2. Everyone does it and 3. not $117 worth of guilt.

Yep, it's illegal to park on the verge ,not sure why they call it a ' nature strip ' , kinda implies that the council left there especially for the wallabies to eat.
When we lived in cherrybrook NSW , there was this guy that used to park his car across the walkway but still on his driveway. I walked passed with the babies in the pram and told him it was irresponsible for him to make me walk out on the toad in order to pass his car. He pretty much told me to ' stick in my family album '
Next time hubby was with me, just fresh from SAS training, all buff and mean looking, took one look at the guy and he jumped in his car and sped off. Never had that problem again.
There was a story on ACA about a new suburb in outer Sydney that the streets are too narrow for anyone to park on , the local ' brown bomber ' was issuing tickets to all of the residents, but I think they managed to squash them. Worth a try to plead ignorance, and get the boss to explain that adequate staff parking wasn't provided.

I definitely understand your frustration with the driveway v walkway and I also got a chuckle from the reason it never happened again

Now I know that it is prohibited to park on the ‘nature strip’, I am not hopeful that I will get the infringement reversed but it is worth a try. Hopefully, because I was ignorant of the ‘nature strip’ thing and that is evident in my letter because I did not mention it, they may just ‘educate’ me and give me a warning.

I guess I got hit because it is pretty much a business area with few houses and under regular patrol .. just irks me that it happens everywhere else in the suburbs, probably without repercussions.

Also, besides being a nature strip, I was not blocking anything, hurting anyone and/or causing a nuisance or obstruction; not really worthy of such a large fine.

Hey, it's a little time and a stamp, I would too. I will be interested to hear what they say as I often park on my sisters nature strip!
