Backing out after paying a deposit?

Me, I'd just go ganbusters and finish the piece, so when you go to court, you can show the judge it is done and have the judge order him to pay and take his stuff home. Make sure you do your best work ever, however... because he will go over it with a fine tooth comb looking for some reason to refuse it.
 
After looking at your website, if it were me, you could any amount of time you wanted too to create what you do. Custom work like that takes time, with or without power outages, snow, etc. Great work --

To give you advice, we really need to hear the whole story. Otherwise, there is no way to really say. Normally, as long as the seller upheld their end of the bargain, NO- deposits should not be refundable. You admit you didn't uphold your end of the deal though. The reasons for that are somewhat irrelevant. You say you are two weeks behind on the delivery. What are the rest of the details? How long will you be late total? How long did you tell the buyer it would take? If you are two weeks late on say a six month deal, it is not as big an issue as if you were two weeks late on a one week deal for example (but really, it is the buyer's money, not ours, we can't really say *why* he is so upset or judge his reasons not knowing his side).

It just all depends on the entirety of the situation. In general, I would say deposits are not refundable, he has no right to harass you, and he should be understanding (if he is in a position to be flexible). That said, you should be as well. If you promised delivery within a certain time frame and you are already two weeks late, you might want to just refund the guy's money. It may not be your fault per se that you are late, but it certainly isn't the buyer's fault either. At the end up the day, which party in the transaction did not uphold their side of the deal?

Most of our people understand- stuff happens! I think getting something one of a kind is worth the wait, and we've never had anyone complain. Until this kook, that is. He's still taunting me/trolling with nasty emails. Like every 5 minutes. Hope I have enough ink!
 
Paypal appropriately rates your behavior as both the buyer and seller. If the contract is not specific, you are probably out the money, if not paid. If they paid ahead of time, keep it--you held up your end of the bargain. If not, next time get 1/2 payment ahead of time, OR full payment ahead of time. Custom jobs are not easy to sell to a 2nd buyer. Seller beware!!

See, that is what I mean about giving the WHOLE story. It changes everything. If part of the reason you are delayed is because he changed the design, he is out of luck, IMO. Sounds like a real jerk.
 
And also- I told him two weeks ago that he could find his own shipper and get it at 6 weeks. We would push his order through ahead of other people. He declined. Our shipper comes through every 3 to 4 weeks. It's part of our carbon offset program.
