I'd still give him his deposit back and call it lesson learned!

Yeah, to be honest, I would too. It may not be that you are in the wrong, but it might be the easiest thing to do and be done with it. Is it easier and more stress-free for you to refund the money and try to sell it to someone else or to continue to do battle with this nut? I know that a lot of people will disagree, but sometimes I feel like you do have to pick your battles. Sometimes arguing with someone is not worth the stress or hassle. I have had some people create more drama over a $5 item than other people have buying a house for heaven's sake. Sometimes, when you are dealing with someone that is irrational, it is just not worth it to fight with them.

Oh- and THIS guy is irrational! I offered him every solution within reason. I can't give him all of his deposit back- that money all went to materials! I did find this however:

quantum meruit
Latin for "as much as he deserved." A principle used to award the reasonable value of services performed by the victim of a broken contract.

Why are you using this blah, blah, blah, stuff? Tell the true story for pete's sake.

Did someone pay you to hatch eggs for them? Then after the eggs were hatched they decided they didn't want the chicks? You supplied the eggs?
How much were the eggs "really" worth? How much was the agreed upon price for the entire thing, eggs, incubation and chicks? If you sold the chicks would the amount equal the agreed upon price? Can you afford to give back the deposit? Do you just not want to? (I'm not saying your a terrible person if you don't want to.)

Tell them the truth. A. I don't feel I should have to give back the deposit after all the work I put in and now I have to dispose of these chicks.
B. The agreement was for me to supply the eggs and hatch them for you. You can either pay the entire agreed upon amount and take the chicks and sell them or forfeit your deposit.

IF, this person is a relative, give back the deposit. Keeping the peace in the family is worth more than the deposit. No the principal of the thing does not apply.
IF, this person is a friend and you don't value the friendship, keep the deposit and say goodbye forever.
IF this person is a friend and you value the friendship give the deposit back.
IF you can afford to keep the chicks and give back the deposit, do so.
IF the person has a good reason for not taking the chicks, ex. lost job, is sick, is an idiot

, give the deposit back.
IF it won't create a hardship for you to keep the chicks, give the deposit back.

Maybe you should read the whole thread before you post...she has said what it's about.

Perhaps I misunderstood because of the the "chicks for example". Was it chicks? Then say chicks. But my original advice stands. If this tiny thing is such an issue it's no wonder we have wars. How much is involved? Truth is the OP is looking for validation to NOT give back the deposit. If they don't it's no big deal, it doesn't mean their a bad person.. Does the term Mountain out of a mole hill , set off an alarm.

Yesterday a friend was backing out of her driveway and hit my car. I didn't make half a big a deal as everyone here is, over what is probably a small amount. Does anyone know what "magnamemus" means , good cuz I can't spell it but I know what it means.

curious why did you chime in ... must of been important enough to you to give your opinion.

Well - the jerk sent me his attorney information. I talked to the sheriff to see if maybe this was menacing. He said don't ship anything or do anything unless the guy pays for the stuff, and if I get any more threatening emails to print them out and they'll put a warrant on him. What an ass!

Depends on if the person will lose money or started the project.

Good Luck

you get more with sugar than chicken poooo......maybe he will be nicer next time around. I am sure he is just trying to scare you.

Have you talked to his attorney? With all of the abuse he set out you should counter sue! You have proof he harrassed you yet you tried to make good on your end. Send him copies of the materials costs and how many hours it took( over charge you costs;) Make your case as he could put a bad word out about your work, get an order so he can't.

I dont think that they should get their money back. Its a CUSTOM made order....
