Backing out after paying a deposit?

Hi Happy didn't read all of this.

For my chick deposits (where I'm custom hatching) it's 50% down and if I don't meet quota, I refund any of the 50% as needed or they only owe for chicks hatched.....So far always met the orders!

But if they want more than their order, I allow additional purchases as long as they are not precommitted.

I've always had the chicks picked up but with the 50% down it allows me lattitude to sell to others or keep....

Now with custom made furniture, I'd require the entire amount down with attached documents for specs etc of the furniture, signed by all parties.

Yup the weather stinks and has been hard for furniture making.

SInce furniture is higher costs than chicks I sure would not back down if I had a good contract. I'd probably get an attorney to flush up the contract as well.

In this economy something with a high ticket and a backout is bad....

I've been bummed when folks order and then back out of egg order at the last moment but at least I can incubate those.

I really don't think this guy has a case against us. I have so many emails where I told him he could have it early if he got his own shipper.It got to the point where I had to tell him I would be out all day- because if I didn't respond to emails in a few minutes he was accusing me of ignoring him and stealing from him. I bet if a judge looks at them , they will laugh him out of court.

BTW Nancy- My Wellie roos (from your stock) are doing a great job. Chicks on the way!

I think he is plain and simply a Bully! He is trying to use threat tactics to get something for almost nothing. I would make a file and keep everything, emails, contracts, etc. Do not refund the deposit and go ahead and continue the work. Once it is done ask for payment, when he refuses, then you have a case against him for Breach Of Contract.

Did you change your web site? It now states deposits are non-refundable (GOOD idea).... BEAUTIFUL stuff!

I agree that you should just report this a@@ to the authorities. He is a whack job.

Maybe instead of printing off all those emails you could copy them all into one file and put them on a flash drive for the police/lawyer. Save on ink!

Yup..i agree.He sounds like a rich, spoiled brat that is used to bullying people and throwing around his money to get his way...
I'd not give him one red cent back..until i was able to sell the piece.
