With BR, the females have darker feathers and legs. Here the feathers say female, but the legs don't. I feel like I need to know the breed 100% to judge the comb, too. Where did they come from?
I know what you mean, thats why I am always in doubt of the gender even after so much online research. I got it from a private seller, who got the eggs from a friend so not really a reliable source of chain. I feel like there are too many mixes now.
 
That comb does look boyish. However, if it's a marans, there is still a chance it's a girl. Marans tends to have a large pink comb early. My splash Marans hen had a similar large pink comb like that when she was 5w old. I was worried that she's a boy until she started to lay. I cannot tell if she has single barring or double barring though. If she has more white than black, it's a double barring male for sure. But it's not very clear for her, so we will have to wait to see.
 
11 week update, the legs are yellow compared to when it was 5 weeks ago. Still unsure if its a hen or a roo and the exact breed (whether its a mix of cuckoo maran), it starts or picks fights with other often (especially with the 10 week old jubilee orp in the attached pics, which I believe is a hen from the features. Please let me know its a roo and not a hen).

It's a cockerel. Long curling tail feathers + big red comb + green/black feathers on the wings. I'm pretty sure purebred barred rocks can't have those green/black feathers at all. Maybe others can chime in if any other breed with a cuckoo pattern can have those feathers, otherwise it is in fact a mix.
 
Since he's starting to get a crest as well as the large red comb, a possible explanation is he has legbar rooster and some kind of black hen as parents. The bright yellow legs work for legbar/rock cross- but there are lots of possibilities.

Hopefully you wanted at least one cockerel.
 
Thank you guys, unfortunately where we live we cant have roosters although we would love to keep it.

I am guessing that this will work better if you are in a populated area, because it will be more likely that other BYC members will also live there.

I have used craigslist with pretty great results. That seems to work better in rural areas since there are usually more folks looking for roosters, but not always.

There is something called Front Porch Forum in Vermont, which is basically a listserve for each town to post announcements. I have actually had people pay me for roosters on there, just $5-10, but still something.

I am guessing by the light of probability that you do not live in Vermont since we have the second lowest population in the US (assuming you are in the US), but there are some other neighborhood forums I have heard of (like nextdoor.com). Maybe a web search for "neighborhood forums in [wherever you live]" may yield some results.
