Good luck Texans, my hopes and prayers are with y'all. At least you don't have to deal with a neighboring state with a city that thinks roosters are exotic animals and it's okay to keep 4 hens in your backyard. I still can't make sense of that one. LOL

In the City of Houston the real issue is the 100ft distance requirement btw coup and residence. No one has that kind of space. As written it seems they'd still be able to impose that restriction.

"A municipality MAY impose....including:....the minimum distance an individual must maintain...".

The original bill set this distance at something reasonable like 20ft or something. This one took that wording out and opens it up to the local authority.

Keep reading...it says basically that they can impose a certain distance but that that distance CAN NOT keep you from having 6 hens.

I hope you are reading it right! I read 'C' to say that any other law that conflicts with 'A', 'A' takes precedent then 'A' says notwithstanding any other law, 'except as provided by subsection B', and 'B' says it is ok for distance restrictions.

Let me go re read the new one..
I know for sure the last bill was worded that way.
I assumed they were the same thing just a new bill number.
Maybe I am wrong.

(b) A municipality may impose reasonable governmental
requirements on the raising or keeping of poultry in the boundaries
of the municipality that do not have the effect of prohibiting the
raising or keeping of six or fewer chickens, including:
(1) a limit on the number of chickens an individual may
raise or keep in excess of six;
(2) a prohibition on breeding poultry;
(3) a prohibition on raising or keeping roosters; or
(4) the minimum distance an individual must maintain
between a chicken coop and a residential structure.

I read ^this as they can require you to keep it a certain distance away, but they can not require that certain distance to be so many feet away where it will not allow you to keep them.

Don't know the size of the lots or homes in your neighborhood, however I have found that most neighbors are okay with chickens, in fact many are interested, especially if you free range in your front yard when most people (read kids) are home. Moms will bring strollers for blocks to show their tots real chickens in the city. Older kids like to feed them. Check with your neighbors, don't spend to much at first, be prepared to re home if you run into a jurk and get yourself some chickens. Remember it's your yard and if you don't make a spectical of your coop, perhaps no one will come over with a ruler.
