Breed and Gender (really stumped)

My roo buff orpington has turned out not to be a buff orpington. Is he even a he? He hasn't crowed or showed signs of the possiblility of crowing. He is almost four months old. The pictures below span 3-4 months. What breed? What gender?

Yeah I was thinking it looked like my Hampies... I cant tell sex but I think I see saddle feathers in that first picture... not sure I would need a close up.
 
Legs look a little small for a male. If I had to guess I would say girl.

edit: wellll looking again at that final pic and comparing the combs has me second guessing myself.

That is a boy for sure. You can see the shiny (and pointy) saddle and hackle feathers. Looks like he might be a new hamp or production red. I'm guessing he's from a hatchery or feed store(from hatchery). He probly was accidently tossed in because of his color as a chick. I've ssen other posts where hatcheries have sent the wrong breed, but the buyer didn't know until the chicks where older.
