BYCers I need To Talk To You All

Mark, you are an animal lover so I trust your judgement and perspective
on your uncle's situation. You know he takes care of them but the ASPCA
are going in with preconceived notions.

I would make a case for him. Take pictures of him caring for the animals.
Make sure he ALWAYS has food, water, and shelter. Tell him to keep all
his feed receipts

We ran out of dog food last night. My wife had to get more this afternoon.
If the ASPCA came to my house on a complaint and I had no food it would
look bad. I'm not saying your uncle ran out of food I'm just using
this as an example.

Your uncle needs to cover all his bases so if they ever do take away any
animals he could go in front of a jusdge with evidence to defend his case.
 
could be they are flexing their muscle, if he's got the most animals in the immediate area they want to take him down as an example, regardless if they are in the right or not.

could be if there's construction in the area his farm might "be in the way" and they're using this to get to him, trying to get him rooted out like an old stump in the way of the plow.

could be the neighbor.

could be they want attention in the media, hoping to bust him so they get front page headlines to use to get money donations.

could be they're just bugging him to get a lil cash out of him here an there, either through fines or through bribes to get them to leave him alone.


time and time again it seems to me that those who are the "enforcers" of the organized groups such as aspca are bigger politicians than anything. the really devoted animal lovers i've met over the years rarely belong to any groups, and if they do they belong to groups that promotes the animals they enjoy and care about rather then trying to instill their beliefs on other people......yes, i am a bit of a conspiracy nut at times, especially when it comes to people trying to dictate to others what they should do with their property, animals, or family.



i hope you can get to the bottom of this and that things work out for your uncle.

They need a court order to remove animals from the property, do not surrender the animals if they don't have one.

You need to get a written copy of what laws your uncle is supposed to be in vialation of, document all conversations as to time, place and date.

Get complete pictures of all the animals living quarters including a pic of the dog sleeping inside.

Contact a lawyer.
 
This is very confusing to me.

i am gonna try my best to understand it all..

the animal guy that was over today ask my uncle if where he lived at was a animal zone? and my uncle told him ( you should know that your the animal person )

when my uncle bought that house about 4 years ago the owners said and gave him papers saying he could have any pet weather it's poultry or whatever.. and even other people on the road has chickens.

Oh yes PC i am gonna do all of that i am standing by my uncle on this 100% they are not taking his animals.. not while i am around.
because they do not have strong facts as to why they are taking them
i am going with my uncle this weekend to figure out more info on this.

Well there is your answer right there!!!!

Some prick cop is using his connections to harass your uncle.

If they ask to see his property or animals DEMAND A WARRANT. It wont hurt to have a lawyer familiar with this case either.​
 
1st-- no one can legally take his animals without a written list of violations, and he then has 30 days to fix them..
Get documentation....
also-- check on ordinances--
many areas limit the # of animals per acre of land... and the cop may be in violation as well--
same as noise ordinances-- check on what if any are in place-- then whenever the hunting dogs go at it-- file a report.

His animals are comfortable, cared for and well fed-- ask a local farm vet to come out and examine them and get documentation certifying it from the vet.

sounds like the Cop is using his Cronies to get at your Uncle for personal reasons, and he COULD be brought up before the board for abuse of power.... Call the station and complain... fight fire with fire...

just cuz someones a Cop doesn't make them right, or GIVE them the right to use their position to intimidate .
I come from a large family of Cops (Grandfather, Godfather, Uncles, cousins) and what he is doing is unlawful if not illegal.

Get a recording of the dogs barking, you might need to use it.

Perhaps you could help your uncle by shooting a video of his property -- showing how he provides the animals with safe and clean shelter from the elements, ample supply of food and fresh water, that the animals are fat and happy. Take photos of the "violations" that are being alleged while the SPCA are pointing them out. Take photos as each "violation" is fixed to meet their suggestions (orders). Do everything you can do to clean up the property -- make sure there's no wires sticking out where someone could get hurt, no hazardous trash of any kind, all doors and windows are in fairly good repair, etc. Document it all in photos and video. Then, if necessary, present it to the judge if they are able to get a warrant to seize his animals. They can't keep them without going to court, so be prepared to prove your case.

Oh yeah, and DON'T let your uncle lose his cool when they come around. The more cooperative he appears to be the better. Whether they deserve it or not, everyone should be treated politely. It'll be harder for them to get obstinate if your uncle acts like he's taking notes and trying to do what they ask.

And feel free to report the noise problem created by the neighbor's dogs. Even record them for an hour or two to hold as evidence that the dogs are a nuisance.
 
Yea i plan to do all of that.. my mom is going with me tomorrow over to my uncle to take pics and video of everything and video how loud you can hear the police officer dogs from my uncle place

we are gonna go over every inch of the place getting any nails or anything we see up clean up even more than it already is.

i hate to see anyone animals get taking away when they are doing a great job at taking care of them.

and we are making sure my uncle gets a lawyer Asap! on this
