It doesn't matter the breed. A small dog has a worse bite than many people realize. They can be quite dangerous. And a small dog off-leash is dangerous to people who are walking their dogs on leashes. Just look at my friend whose (large breed) dog was charged by a floofy dog: the floofy dog's owner got bitten by my friend's as a result of having ignored the leash law.

My friend, by the way, was absolved of all charges by police and the woman who was bitten was cited and will have to pay her own medical bills. Serves her right.

Not often do you hear a 6ft 200lb+ man shooting a Chihuahua twice in self defense. LOL

I agree that the woman should be charged or warned. I know here that people recieve a couple warnings before being charged with anything, because accidents do happen and occasionally the responsible owner gets an escaped charge. Not saying that the owner shouldn't be liable for any damages produced by her loose animal.

I also agree that this should be moved to a seperate thread, I would start it, but I've completed all I had to comment on the subject. LOL Sorry for contributing to the hijackment.

Hello everyone I’m still waiting on paper work.

I can tell you the police office said plainly that because Mr. Gapp had lost the dog and was grieving. He did don't ticket him.
Also that he could not ticket him if he did not see the dog of leash himself.
Also if he did ticket him it would be a first time offence and he would get off with little consequences.
I could ticket him and would have to testify to the dog being at large and again it would be a first offence with little consequences.
Yesterday I spoke with my arresting officer again, the best thing to do is for me to get photos, action film and then I could ticket them, playing police officer for my community. The officers by the time they get out here if they get out here. These are low priority calls if something else comes up they may not even make it. (I understand and would want them to take a higher priority call) if it was only a dog or dogs at large.
But like what happened at my home you can’t always wait you can’t just take a photo should not just arm yourself with a camera or a phone. They the police are a reactionary force just here to pick up the pieces, trying to piece together what happened after the fact.
I picked up the police report today very eye opening. We are considering our next move, again waiting for paper work.

Glad your charges were dropped Mr. Harris and I am looking forward to hearing what you have to do to resolve this for the best of your family.

Want to say welcome cause I can't remember if I already did or not.

Ed I think that was just a cop out. He didnt see the dog off the leash. I would say he did , didnt he see the dead dog. Sure it wasnt on a leash then

Ed, I am sorry you were put in such a position and I know it must have been hard for you to kill the poor dog. I think you did a service to your neighborhood eliminating a serious threat. I would love to hear from Cesar about how to deal with rogue / marauding dogs. I have had some run-ins, but no outright attacks yet. I am grateful that I haven't been in your position.

Definitely "just a cop out." Does the police officer believe the dog was on the leash when he was shot? That Mr. Harris shot while the man was holding the leash? When the dog was found, did he have his leash still attached?
