Mr. Harris I have chills after reading what happened to you. I just want to say I feel sorry for you and your family. You never should have had to go through that. It makes me ill that the dogs owner forced you into that situation and that he has the audacity to blame you for his irresponsibility.
 
It was a pellet gun, I don't think he meant to kill it, just scare it off and make it not want to come back. I can't believe they're even considering that "discharging a firearm." I didn't know you couldn't shoot pellet guns in town, however I am new to urban life having grown up in a farming community, it's kinda hard to get used to:) All these rules!
Hope he doesn't get in to much trouble, I vote accident.
 
Thanks for sharing the story, it really settled all of our questions of "what happened".

You have that right to defend yourself, your family and your poor chickens!

Are your chickens ok? Any losses?

Mr Gapps, I hope you learned from this mistake. Remember this when you take your dogs out for a walk! Do not let your dogs off leash, no matter what the temptations are or any thoughts about "oh, they will never do that".

Mr Harris, hope all the charges are being dropped. So much for the neighbors.

I guess I am lucky to live in West Virginia. There are sometimes disadvantages, but at least for us, who live out in the country, there is less govt involvement than most places, I think.

What I'm still curious about is at what point Mr. Gapp went back for his car.. The news story said he came upon the house (as though by walking, which Mr. Harris confirmed), then discovered the dog, 'collapsed' and sobbed like a big fat baby, then carried her back to the car...

Where did the car come from? At what point did he discover his dog? And I'd really like to know, from Mr. Harris, how exactly did he react when he found the dog? Did he really collapse to the ground? Were the cops still there to witness his blubbering?

Not that any of it really matter, of course...case closed, and all....I guess I'm just curious to know whether Mr. Gapp was as emotionally distraught as he claimed to have been when he was on camera....

CM, yes those are the remaining questions but it was for Mr Harris' side of the story.

Now if this gentleman can tell us how this dog owner came to the spot?
 
Mr. Gapp came walking out of the private woods on to my property while I was talking to the officer. Mr. Gapp said he had been home and back while the attack was happening. No evidence that he was even with the dogs at any time. Tells us he heard and saw nothing and that he is sorry.

We never heard a sound or whistle before, during, or after the attack.

Mr. Gapp had left while I stood and talk to the police more. As he left we could hear him calling and blowing his whistle into the distance.

Mr. Gapp came back alone around 30 minutes later. As he drove done the street yelling for the dog and blowing the whistle, he went to the end of the street and came back. He parked in Front of my property we could clearly hear him even when he walked in to the woods where I joined him.

I was the only one with Mr. Gapp when in found the dog, being a few yards away he did scream and fall over the animal. I tried to get help for him. Offering to call someone for him and offered to carry the dog to his car. He said “you have done enough”.

He struggled with the weight of the dog dropping it three times. I offered many times to help trying to get him to rest. He asked me. “Do you own a dog?” I said “No But we are looking to get one.” He then tells me. “A person like you should not have a dog.” Says something about. “All this over chickens”. I said. “What about my kids”.

I offer him water, again to carry the animal. As we got to his van is say something about “I hope you’re happy, all over chickens.” I say. “That’s enough.

We look over the dog; we cannot see any blood or a wound of any kind as he puts it in the back of his van and leaves.

On the ground were the dog was found not a drop of blood. I’m told it was not a heart shot and the police did not report that it was a heart shot to the media.

The police return later to arrest me.
