The dog wasn't on "a public place, highway, or within the corporate limits of any city". It was on private property.

Know your laws, is right also understand what you read, this dogs was on private property.

Thing is, you're assuming that the stick will work.. What may very well happen -- what is likely to happen, I'd say -- is that the dog goes after you for hitting it with a big stick.​

I have been reading this thread since the beginning and am just wondering how anyone knows the guy really went in and got a second gun. That is just hearsay from the dog owner from what I have read. The dog owner wasn't there so he could just be skewing things in his favor. It has just been interesting to read all the different views and responses so far.

I feel the owner did the right thing. Good for him!!! I had a pitbull that a neighbor was sitting for a friend. While visiting, it came onto my propery two times and killed 15 chickens. I called animal control and was told I had the right to fire when it came back. Guess what, I did just that. I sent it packing with buckshot burning a new one. I enjoyed every minute of it and would do it again. I feel my animals are now justified. I have been given payment for them, though not nearly enough, and the female is back with her owner, not anywhere near my property. I just hope no child suffers as she was not forced to be put down.

No dog can be generalized by breed. There are always exceptions to every rule and some breeds do not deserve their reputation ... good or bad.

And just because a dog will chase/kill a chicken, does not mean that it would harm a child.

Once, when my daughter was younger, she came in the house crying and with only one shoe. She was riding her bike back from a friend's house when a neighbor's golden retriever chased her. Thankfully, the dog just got the shoe. She also dropped her back pack, and her books were strewn all over the road. Of course, the idiot owners swore that their idiot dog would never do such a thing. Since it was the word of an 11 year old vs the word of the owners there wasn't a lot the law could do. The dog did go on to bigger and better crimes and eventually disappeared (no, I didn't shoot him but somebody probably did). There are 2 problems with this sort of dog owner. First, they let their dogs run loose. Second, they deny that it was their dog when something goes wrong. It is that sort of irresponsibility that gets so many animals killed.

Oh crap, y'all...

I'm not a lawyer, but ORS 609.150 (3) looks bad.. Really, really bad.. I know Jody found the city code which authorizes use of a weapon in "lawful defense" of property, but if ORS 609.150 (3) makes it specifically unlawful to kill a dog that's chasing chickens within city limits...well, that would seem to kinda rule out the "lawful defense" clause in the city code.

At this point, I really wouldn't be surprised if they're both found guilty -- Harris of animal abuse, of killing a chicken-chasing dog in city limits, and of firing a weapon in city limits, and Gapp of letting his dog roam at large.

This is bad. I mean, jeez...it reads like ORS 609.150 was amended specifically to nail Mr. Harris to a cross.
