Everyone said pullet when I previously posted the above pic, but...
what about this tail coming in in pic below...

Depending on the age (I guess maybe 14 weeks?) and the breed, I would still lean toward pullet. Can you get a better pic?
 
He/She was about 7 weeks old in top pic. Bottom pic is 10 weeks old. I am concerned about the long tail feathers curving at the top of the tail in the bottom pic. But I will post a better overall pic tomorrow when it's lighter out.

Do hens ever get the curving tail feathers?

Yes, a lot of EE hens have slightly curved tail feathers.
 
My EE's all have huge, gorgeous tails - an they are all hens/pullets. My guess is pullet.
 
A better picture would be helpful. That's a rather red comb for a 10 week old pullet.

My first thought was pullet, but I'm seeing some rooster signs. Can you get a close shot of the comb?
