Is it a straight 3.5 feet off the ground? It might not be to bad it there is a roost or two that they can use to climb up to them on.
 
the police have been great, they actually went door to door asking if there was a bb gun in the home... we havent found anynew pellets in the yard so hopefully the parents did something about it!

At one point we had an old ladder in the coop, coop about 6 foot inside. The chickens would fight to get to the top, quite funny to watch. After a few to many knock downs we pulled it out, but have many roosts. The latter layes at a slight angle in the yard now and they love to play King of the Hill.

I'm glad the police went door-to-door. I was going to suggest you do that. I would be inclined to think that a child owns the BB gun and was not being properly supervised!!!!!!!!!!

Even if you never find out who did it, informing all the parents in the neighborhood might stop the problem. If that were my kid, they would never see their BB gun AGAIN.

That is absolutely unconscionable! First: what are the laws on chicken-keeping where you live? If your birds are legal, call the cops on the neighbor. What they did is cruelty to animals, not to mention criminal trespass. Your birds were on your property and they had no right to shoot into your yard for any reason. If the neighbor makes another attempt to shoot at your birds, try to get a pic of them doing it and send that to the cops. If there is any doubt about the legality of your birds, though, you could cause trouble for yourself if you report them.

Glad to hear that they have a new, safe coop. They will be protected from predators now, winged, 4-legged, and 2-legged. Can't wait to see pics!
 
I would think it could only be one of three neighbors, most likely the one(s) with kids. I'd go confront each one. If any one of them has a bb gun then it's a no brainer.
 
You could get one of those fake security cameras and set it up in your yard with a big sign "Smile! You're on camera. Trespassers will be prosecuted."
