Fences dont always make good neighbors... Pics at 11

My folks had an easement to get to a portion of their property (they purchased two parcels that were catty corner to each other at the same time). One was landlocked, and there was an easement access from a road to the north; it crossed along the west side of a neighbors property, through their other parcel to the "back 130." If they had not also purchased the front parcel, the only access would have been through the easement, which was a single lane road width. They never used the easement as the access from the front parcel was far easier.

For the OP, an easement through your parcel makes no sense. An easement TO your property does. I think you need to verify exactly where the easement runs, and where your property boundaries are. To prevent a de facto easement, do not allow access through your land, or alternatively, give deliberate permission. This will prevent creation of an easement. You might want to reference this thread in the Legal section. There are several pretty astute posters there that can give you some direction.

Maybe it's just because I'm tired.......but are you sure the easement isn't for YOUR access and not hers? Now that you've got the plat up, it looks to me like she can access both the left and right sides of her property off the driveway. YOU are the one that can't access your property without going thru hers.....so it seems to me that the easement is serving YOU, not her. In which case, she needs to quit driving thru your land and start going in her land on the right hand side and going around the pond to get to the back part of her property and while she's going that way, she can stop and fish and stay off your yard!

The more I look at your plat, the more convinced I am that the easement does NOT extend through your property, but only TO your house. If the former owners chose to extend the roadway/driveway farther, that does not extend the easement. Put up a gate (with a padlock) blocking access farther than the ROW is platted. Extend your perimeter fence to meet it, if necessary.

Maybe it is an easement for them (the OP) across the neighbors ground to access their property not the other way around. Looking at the plat map that would certainly make more sense.
 
I'm writing about your last line. I actually have a 5 to 10 year plan which ends with me living on two acres outside of Pueblo, Colorado. My dream also includes some vegetable and fruit farming and a nanny goat. Goat cheese is almost as good as perfect eggs. It's a lot less expensive living where you can look at three diffesrent mountain ranges rather than living on one. We look forward to the day when we sell this house in Hot-As-Hell Texas.

Not quite sure what your post has to do with this thread or whose last line you're referring to.

But have you ever been to Pueblo Colorado? It's hotter than you know what for part of the summer.​
