She is not breaking the law, committing fraud or being a horrible person by filing her claim and doing what she wants with the money.

The store does have liability insurance for incidences exactly like this.

I don't disagree that the amount is reasonable because I know what it cost to repair even a very small dent. The issue for me is that you are advertising intentional fraud on our web site. I know in my state, this is considered fraud no matter how you look at it. When you accept payment from an insurer, you are supposed to use it to repair your loss. I work for an insurance company and it is cases like these that drive insurance rates through the roof and impact all of society. I also know that we have gone to such lengths as to stop issuing checks to people because of this type of activity and checks are now made directly to the repair company instead. I don't think you're a bad person, just misguided by your wants and desires.

Jody, please let me assure you that in California, it is COMPLETELY legal. I am under no legal obligation to fix my car. My (separated from) husband owns an auto repair business and I have 100% confidence that this is exactly the truth.

Edited to add: His shop is mechanical repair and not auto body repair and he was completely uninvolved in the estimate.

LoneCowboy heres what you need to do, sit in your car with the motor running and wait for a lose cart, quickly park in front of it , bingo , incubator!
 
Okay, insurance fraud is SO not on my to-do list for today, so I called 4 insurance companies and they ALL said I am completely free to do with my money as I wish. State Farm, Farmers, Liberty Mutual and Geico....all agree. Whew (wiping sweat off forehead smiley)

You have nothing to apologize for! It is your money to do with as you please. We had someone make a illegal left turn in front of us and we t-boned them. It took over a year to get the other person insurance company to pay us. First they offered $3000. Then 4 months later said they would only pay $800 for repairs after we shopped around at 4 different auto repair shops. Then hubby told them he was taking them to court. Well guess what in the very end they paid us $5000 for the damages. After their lawyer told them they would pay even more if we went to court. My husband bought the parts at a discount and repaired it himself for under $1500. We used the rest on ourselves. It your money to do with as you please and don't feel bad. No one knows you or has walked in your shoes and no should judge another in my book. You get the best incubator you want and enjoy every minute of it.

I am not begrudging anyone money that comes to them in such a way either, however....
I work with the developmentally disabled and I feel for the employee. If accidents like that happen often, and they DO happen, developmentally disabled employee or not, it may discourage that grocery store from hiring more developmentally disabled people in the future. My eight "kids" as we call them at the group home absolutely LOVE to work at whatever jobs we can find for them and rarely do they buy for themselves with the money they earn. That's why my bedroom, like alot of my co-workers bedrooms, are full of stuffed animals. My kids think that's the very best way of showing us how much they love us back.
 
I think they would just give him other responsibilies. Like sweeping the floor or something like that. Places are getting much better about hiring the handicapped. I wish they were better about it when my Aunt was young. She could have held down a job just fine.
