If Tom is in rehab and doesn't attempt the therapy they request of him (walking etc) they can kick him out because insurance won't pay. Because rehab is for people that are able to to do this
And yes, he can get kicked out after his allotted time that Medicaid is giving you, but Medicaid can also override it.But don't see that as a negative. It just means this is not the right place for him.
What you need to do;
Tomorrow call the number on the back of Tom's insurance card. Tell them everything including this place has no extra Medicaid beds, tell them he is walking some but needs help. Tell them EVERYTHING.
What you want from the insurance company-
1) A list of Medicaid rehab places that they DO cover in case he needs more rehab
Ask them what/how long they cover rehab.You need this info from THEM, not the nurses.
2) What home care services they cover in case you need to bring him home and what help they offer in getting your home ready (hand bars at shower etc)
3) How they can help you if he needs more care at a retirement village.
A big load will be lifted off your shoulders just knowing. Your insurance is your best friend right now. They do not want Tom to be 'kicked out' . They make these rules because they want him to get the right care. They didn't want someone to be forced to walk if they can't- but apparently he can, he just may be slower. Meaning he may need more time in rehab. Don't fear Medicaid, in my experience what seems like terrible rules are actually rules put in place to protect our most vulnerable people who can't answer for themselves. Often times, insurance get more helpful information from Loved ones then Drs and nurses.
They can ask the Dr to put in writing what you just said and will override their own rules. But you have to make them understand.
Once you have this info, you can call other rehab places with Toms info and plan ahead if worst case scenario you need it. But don't sign papers.
Every states Medicaid has different rules. They can not take a house you are living in. I don't know if they can place a lien on your house in Indiana. But if both Tom and your name is on the title, they can not claim your share. Right now is the time to talk to a Medicaid lawyer who also understands estate law. Only a lawyer can remove Toms name because he has dementia. The house could not even be sold as is because Tom can't sign.
I've tried the Robaxin It didn't do anything for me. Why did you have pain like that so young? I had a terrible visit with Tom today.But you got some restful sleep didn't you? Maybe it is just time to take one and sleep in your bed again. Evict the dogs to their crates. They'll survive and you will too. I can't take flexaril as it makes my heart beat funny. I use Robaxin. Ask your doc what she thinks best for you. Robaxin doesn't make me drowsy and helps a lot with back and shoulder cramps. I've fought with shoulder and upper back cramps since I was 19.

In my experience they really do care about people like you and Tom. Not only do they want what is best for Tom, they also don't like to see this burden on you. They will help you make sure he gets taken care of IF you let them know. They will stay on the phone with you and personally call the other party and be on 3-way calling with you.
Believe me, the last couple of weeks have been very difficult dealing with insurance and Medicaid. But nothing feels better then having the Medicaid office and insurance give me personal calls and everything fall in place when it felt it was impossible.
