I hope RBA sides with you on this one. The individual you're talking about has been shady on more deals than just this one. I sure hope the chicks survive! How are they doing now? Didn't he offer to refund $50 for the dead ones? That is right in his Paypal reply. Can't you claim that at least and still be done with him?

Yes, he offered a little less than $50 then He still wanted me to ship the others back or kill them. I won't do that. So I denied there claim.

I have been giving them meds, acv and Vitamins & electrolytes in there water and spraying there legs with scaly leg mite spray and rubbing petroleum jelly on there legs. There is 1 little one in the batch that isn't looking so good. I have been trying to work with it. But I am not sure it is gonna make it.

Paypal immediately takes the funds from the sellers account when a dispute arises. The money is essentially in paypals own account. Paypal has grabbed it back from the sellers account in case they need to pay you. They will give it back to the seller should the seller win the dispute.

Well sadly I just went to check on them and the one that wasn't looking good was dead.

So now I am down to 6 instead of 9.
 
I thought it was $50 refund for the dead and miscolored ones and then a full refund if you killed or sent back the others?

It was $48.88 for the ones then they wanted me to send back the others to them for a full refund. They never offered a partial refund for the sickly birds they sent.
 
Keep proof, as gross as it sounds. Take a pic of the 3 deceased birds together or he might end up claiming that the newly deceased bird was one of the original two. Sounds harsh but it helps "prove" your case and he sounds like the kind of person who would dispute that it was a third one.

I took pics of the one that just passed for proof of how skinny it was. You could see the breast bone.

They are all still weak from the trip and from being sick. If I sent them back they would all for sure die. So that is not an option in my book. You can't reship live birds after they just shipped. I don't know what pp is thinking.
 
Most of PP rules are not set up for live animals, they're set up for eBay. The same company that owns eBay owns Paypal which is generally set up for "goods". Requesting that the buyer return the "item" for a full refund is one of the selections in the drop down menu for the seller to choose in how to resolve a dispute. The seller is a JA for choosing it and you've got a case that's out of Paypals typical wheelhouse. I'm with the others and encourage you to call PP and explain the situation. Any reasonable person would not request that you send the chicks back.
