The OP sounds like she is talkiing about a mobile home/trailer or RV vehicle. It doesn't sound like a land/house title. I do hope you find somewhere to go and be safe.

Once again. Any title company will require a title insurance process. This protects them, the lender and the purchaser.

The HUD contract is binding EVEN IF YOU DO NOT WRITE A FORMAL CONTRACT between the buyer and lender. This is why it is ALWAYS signed and recorded.

The HUD contract requires title insurance and it is included in a transfer of title. It is legally binding even in a court of law.

One has to get title insurance even if they FORECLOSE on property.
 
hello to all that has answered my ?`s.We did go to a private person and they suggested that we take it to Small claims court.But we have not as of yet.And we had to go and borrow some money and that took our Blazer and pop up camper Titles.So this will take us forever to pay.It is all a big mess.We paid for this trailer from a trailer place.So it was used and we needed a place to go so bad,that I did not think about a title.But I did see the title that day.But I know that it could be a lot worse,I just want to cry,:(Thanks for all the help,and I am going to have to try to get some help.The trailer is on our own land, Sorry it has been a long time since I have beeen on here,BackSwampGirl,,,,,,,,Sandra

I guess I am wondering exactly where the OP stands on this. Are you still in possession of your trailer/home? What has the dealer said when you contacted them? Did the most recent money you borrowed take just the title to your Blazer & camper, or did they take possession of them as well? The places that give loans in exchange for vehicle titles are loan sharks--legal, but a very bad choice. The interest in some cases can be several hundred percent!

Small claims court does not require you to be represented by an attorney, but you sure better know exactly what you are doing, and have good documentation WITH you (no matter how good it may be, if you don't have it for the judge to see during the hearing/trial, it is useless). If you feel that you were scammed, laws were probably broken, and you should notify the police or district attorney.

Does the seller have a business license--if so, he may have violated the terms, and it is possible there is recourse through the licensing agency (contact them). Have you filed a complaint with the Better Business Bureau?
