It seems as if at least you understood they were dogs being dogs and ended it humanely/appropriately. I hate it when people just want to torture predators....domestic pests are human errors.

Not a word to use in this area of the forum. Legal is legal no matter how you look at it. Check out the sticky in the Predators and Pests section.

it depends on the part of Mass where you live Pringle. it seems like the closer you get to Boston the less likely you would be able to treat a dog like a predator and get away with it in a court if it even ended up there.

i think i would try and do a list.
1st time: inform the neighbors (if the dog was only running in the yard and did not kill anything yet.) and inform the AC or police, whoever is in charge of animal complaints.
2nd time: with paint ball preferably, a warning shot if they are threatening, a hit if they have been snatching and/or killing, and a call to the police/AC. along with a list of damages to the neighbor for birds/items lost and the intent of taking them to court to get the $$ to replace the birds and items damaged.
3rd time would be the last straw and a bullet! (if you are a minor i would have a parent/guardian do it)

i think Mass has the '3 strikes and your out!' law so it should apply to animals too.

i should have stated that if the first time was a kill of your birds, that give you the right to just go to the 3rd time rule-skip the paint balls and go for the bullet!

Yeah I guess im conidered a minor and I live pretty far away from boston 3-4 hour drive I think.I dont really see how its so cruel though,I mean it must seem pretty cruel for that dog to be ripping my birds apart and me being deppressed for quiet a while. It killed my chickens and they are gone from me forever far more "cruel"then getting a little bruised up with some paintballs.

Straight form the Massachusetts State Statutes ......

Chapter 140: Section 156. Killing dogs under certain conditions; wounded dogs

Section 156. Any person may kill a dog which suddenly assaults him while he is peaceably standing, walking or riding outside the enclosure of its owner or keeper; and any person may kill a dog found out of the enclosure of its owner or keeper and not under his immediate care in the act of worrying, wounding or killing persons, live stock or fowls, and if any person shall kill or attempt to kill a dog so found, and in the act of worrying, wounding or killing persons, live stock or fowls, he shall not be held liable for cruelty to the dog unless it shall be shown that he intended to be cruel to the dog, or that he acted with a wanton and reckless disregard for the suffering of the dog. Prompt killing of a wounded dog, or a prompt report to the owner or to a dog officer of the wounding of the dog, shall be considered evidence of sufficient regard for the suffering of the dog.
