SpaceCowgirl, are you in Texas? If so, it is illegal to write a check that you do not have the funds for on deposit in the bank. Cash the checks, get them marked "Insufficient Funds" and turn them over to the Attorney General. It won't get you your money back, but revenge is sweet.

I repo'd a truck from MY BROTHER this week because he wouldn't keep full coverage insurance on it. Seems he couldn't afford the insurance, and the beer both. I sold the truck today!

If someone besides you knows about the verbal agreement, he is obligated to pay.
If he doesn't, it can be a lawsuit that he will more than likely lose.
