The reporter got a hold of the foreman and he confessed to having complaints from customers before and offered to come back and do some more work and give me "some" of my money back.
At this point I feel had and do not want to deal with him any further. When I talked to another local contractor he pointed out to me the mistakes done at laying the asphalt... it is graded improperly, I will be getting water damage draining to my garage, he didn't treat the overlay over the concrete part correctly so that won't adhere, the sides are going to be coming up any time now, there are rough patches which means he didn't lay the 2 inches of asphalt you need instead he spread it too thin....
I don't want him to come back because I doubt his abilities and I don't feel he will be reasonable and give me a fair deal. He already acted mad at me when he presented the much higher bill and saw my reaction and went on about him having all of this material in it, the equiptment cost money, the gas to drive so far cost money, insurance, workman's comp, paying his 8 helpers...and on and on and on....but if that was the case he should not have quoted me 2-3 grand if he has that much overhead.
But according to the local contractor he said it looks to him like the guy had about 30 ton of product on my drive when I need more like 50 ton and the cost for 30 ton for materials is $1500.
I was scammed and I fell for it because I just moved and making an improvement on the house on a drive that needed repair sounded good to me at the time...but the cost is an issue and now that I've learned...the workmanship is a huge issue.
I am a licensed contractor and in Oregon if you do not give the contractor an adequate chance to repair or refund, you will most likely lose any rights you may have.
