Not nice...I have had that happen when selling things before. Makes me mad when I am the one who did the work taking the picture. Even worse when its not their chicken!

I just sent them an email telling them they stole that picture and have reported them to ebay for fraud. I think everyone should do it!
 
To play devil's advocate, the seller is advertising BO hatching eggs and not saying the rooster is for sale. When we post pictures on the internet, they become public domain. We have no expectation of privacy. I can save anyone's photos that are posted online simply by "right-clicking" and "save as"... you don't have to hack into a photobucket account.
This is the nature of the internet...while it may upset us to see our photos used in such a way, when we post them in a public forum they become the publics.
