Wow, after having read all 13 pages of this I'm amazed!
On many levels really, but first and foremost, I'm amazed someone with association on BYC would use someone else's photo--without permission--when they could have asked--and likely would have gotten --permission.
I know we are all human, we all make mistakes, but I would never represent something I was selling with an image that was anything other than my own.
My husband is an artist and tattooer, so this is a subject near and dear to my heart (and pocketbook). Whatever he draws, tattoos or paints is his intellectual property, and if he photographs it, that image is his too. He makes his living by using photos of his work--people want to see his portfolio--not someone else's. Or worse, you sit down to get tattooed and find the guy who will permanently mark you has used someone else's work to entice you. You'd be pretty upset huh?
I think this is exactly the same sort of thing!
And she (Jody) has the right to ask the offender to remove the image, period
