Okay I found it! It says

No animal or fowl of any kind, except household pets, shall be kept or permitted in the City within a distance of two hundred (200) feet from the residence of any person, except the owner of the animal or fowl, or except the residence of any person who shall sign a written consent that the animals or fowl may be kept within such distance of their residence.

Any person owning or having under his/her control or charge any animal or fowl who shall permit such animal or fowl to run at large or trespass upon property owned or possessed by another or in or upon any street, alley or other public place shall be guilty of a misdemeanor.

It shall be unlawful for any person to have, herd, or keep any hog, pig, shoat, jack, jenny, burro, donkey or rooster, within the City.


This is all I found concerning animals other than dogs. I have a larger yard but the place I was planning to put the coop/run would be closer to a neighbor's property than 200 feet. With this rule I could keep the quail right exactly in the center of the yard and still be okay. (I might get around this by making the coop portable). I can also ask the neighbors to sign a consent form.

Hmm . . . I still want to visit a local quail farm or breeder just to get a better idea what I might be getting into. I also need to check with the HOA. If they only say chickens specifically I might be okay.

You know I found it ironic when there are rules regarding animal or fowls' housing placement and them can not trespass on other people's property or street etc, there is no such rule regarding cats. At least that's the case for my city's rule.

My neighbors' cats poop on our lawn and in our yard all the time (almost every corner of it), and the smell can gets pretty bad, not to mention I have stepped on their poo numerous times when I mow the lawn or work in the yard and you know the expression on my face when I go clean my shoes

, and I don't think there is city regulation regarding that. Well I have no problem with that, but then why can't we even treat the birds anywhere close? Having your own little birdies which are well controlled of their sound and odor, still have to follow the rule of not within a certain distance of any neighbor's property and such.

I know sooner or later I will not be living in the city anymore.
 
We're also in the desert, and have zero smell from the chickens, mainly as the poo dehydrates within a minute of being laid. I would use a hutch type set up, call them pets if anyone asks, and realize that the calls the males do sound like a songbird not a crow.

Living here in England I don't know anything about American laws.

If you were to get quail, just keep the females they don't need males about to lay eggs. A group of just females are very quite, and if kept out of sight from your neighbours, I would'nt think they would know they were even there. They sound does not travel that far.

As for smell, if kept cleaned out regular it shouldn't be a problem, I clean my birds out weekly and there are no smells from their cages.

Temperture maybe a problem, I have no experiance of that heat here, but if the birds have access to cool shade, they should be fine?

The only problem I see is, if your state for bids keeping livestock like chicken etc, how would you get hold of the feed for them?

I've had my quail out in 110, but not day after day, and sometimes hotter...I froze a large gatorade bottle with ice, and put it in there during the heat of the day, and had containers of sand for them to lay in too. And I have their hutch, that's in partial shade much of the day covered in shade cloth too...

I had them in since I hatched them, and they got SMELLY! They poop LOTS, and I was very happy it was warm enough to put them out at 2 weeks!
 
Quail are not considered livestock but wild game, in Oregon at least. In Oregon quail are not under the rules of livestock but since they are an upland game bird even though not native they are ruled and governed by Fish and Wildlife department. In Oregon you can have quial caged for personal use but you can not sell the eggs (hatching or eating) or chicks without a permit. If you want to sell the butchered meat even to a neighbor you are to go through the USDA and have a USDA approved butcher prepare it. Not sure about other states but this might help Oregon readers or get you in the right direction.

I really hope I can get my own little flock before too long. I need to do more research but I think I can get away with having a very small flock of 10 hens or so. Especially if they are not considered fowl. I mean, my neighbor's dog uses the side of their house as a toilet and it stinks horribly sometimes, and that's very close to our house on one side.If they can do that to us, then I'm sure they won't even notice a few quail over their dog's bathroom smell!

Not to mention the cats that poo in our yard. We have a large population of mourning doves that live in our front yard. They love our desert landscaping and the seed pods dropped by the desert willow trees. They often make cooing noises that can be heard from in the house.

The only HOA rule that I was able to find today by calling them was that dogs must be kept on leashes at all times when outside their yards. I'm going to get a copy of the contract just to make sure there isn't more to it.

I will be lurking and learning, and hopefully when the time is right I can join you as a quail owner.

At the top of the quail forum is a sticky post quail 101, read that a few times till the info sticks. As for the heat, mine are shaded by the house, and there's a mister sprinkler that cools that area for them.
 
just build a small concealed hutch behind a few trees so your neighbors cant see it. unless your neighbors are bird watching maniacs they will not notice a new bird noise. keep the smell down and you can get by with a moderate sized flock
