Little rescue chick?

Hi.
I rescued a chick that has been bullied by other hens and also ducks. I have no clue what breed or sex it is. Looks to be a bantum type I think and about 5 weeks old? Can anyone help with identification and gender please.

He looks like a little cockerel, no idea on the breed.

Nooo!! I don't want a cockerel. I only want hens for 2 reasons. I live in a close neighbourhood so can't have crowing going on....and I don't want chicks, I want eggs to eat.
 
Would a baby cockerel do the movement of crowing but with no sound. I've been thinking he's got something stuck in his throat maybe? He's been stretching his neck and opening his mouth today.
 
I think he's 5 weeks. Going by the fact that he still has a few downy feathers and his proper feathers are still growing. Am I right with the age?

He could be getting feed stuck in throat, I had one that did that when eating grass...She outgrew it...
