i would say boy for sure because even though hens have small combs this bird isn't even fully feathered and has a pink comb and it is big. The hens won't start to get a comb or have it turn pink or red until they get ready to lay. This is a rooster.

I have a 3 week old Blue French Copper Maren hen, can someone tell me the breed standard for BFCM hens?

the cm fights but so does my dominique chick, whick is a sex link breed so I know that one is a pullet. :/

That is a boy!

Pick it up by the scruff of the neck. If it kicks longer than a few seconds it's a boy. If it stops kicking in a few seconds and tucks it's feet up, it's hen. This actually works!

Your not doing something right also the need to be a few weeks old. Hens will even fight for a second then drop legs down. Roosters will keep kicking!
