Massachusetts Dog officer holding my Birds hostage !!

So..you live Ct? Or Mass??
Sorry that shes being such a jerk about this...
I would call your local dog officer and the news station...
 
What is WRONG with people anymore? Just seems like there is so blasted much meaness anymore...doesn't this constitute theft?

Actually, we do NOT know that her birds were found in Mass.; it was implied in post #5, and the suggestion that she might be in a border town was mentioned in #8. My posts were to show that it is not illegal in either location.

IFF it were illegal to possess them without a license in the state they were found, but not where they originated, then I do see some likelihood of red tape to get them returned, but ultimately, I would expect to see them returned.

HOWEVER, possession is allowed in BOTH places, so there is absolutely no authority for her to keep them. And if both the locations from where they were lost and also where found are in the same state, there is not any reason for any sort of redtape paperwork. Unless the OP resides in an area that is under the jurisdiction of this Animal Control Officer (and from all the posts is sounds as if she DOES NOT, then there is absolutely NO authority for her to initiate an inspection. Something does not smell right. I think she suspects something entirely diferent than what she has stated, and think the OP needs to be concerned about WHAT she is looking for. Getting her own Animal Control officers and police involved in protecting her rights seems like an important step. I would also be concerned over the welfare of the birds in her care.

I guess from living in the area I knew about where she lived CT and Southbridge is in MA from the first post as someone from out west wouldn't know.

No, I did not take it as offensive. Just trying to make my point clear; sorry if I seemed beligerant. Post #1 does not say where she lives, although it does list the name of the town, but no state, where the birds were found; you are correct, I had no idea of the state. The profile shown for the OP says she is from Ct. However, in post #10 she says she is actually from Dudley, MA. So, if Southbridge is in MA, then it sounds like it is all within MA. In any case, the whole thing makes no sense, and it does seem like this animal control officer has some agenda of her own.​
 
I do live in mass & the birds were found in mass. I have spoke with mass wildlife , mass agricultural dept..everybody agrees..she shoudnt be keeping my birds.
Ive spoken with my local feed supplier, the town she is the dog officer in..the 1st place she should have contacted when she found them ..but nope..and then i was told that the dog officer has birds also ..hmm ..she buys feed there ..but failed to ask them if anyone was looking for their missing peas ..doesnt seem right. My dog officer in my town where i reside..well he wants nothing to do with it ???? ..thats odd ??..he said he handles dogs & knows nothing else...wow.
Im starting to think she may have thought she was dealing with someone who was clueless about birds ..but is going to be in for a surprise..i have called everybody i can think of about this. They are my birds. Ive raised them & taken very good care of them. They do not run wild..they go in a barn every single night on their own..only that evening some coyotes came around very early & spooked them when they killed some ducks & chickens ..they took off. She acts as if Its a regular occurance that my birds end up in her town ..1x in 3 years ..before this shes never even heared of me. In fact she didnt even notice the huge barn when she came..she assumed the birds were kept loose ..i dont think so. I recieved an anoymous email from my local craigs about a posting I made..it says dont mess around with her ..just great
 
No matter who says dont mess her, she is wrong for keeping your birds, she has no right, It is her job to find the owner, not to just keep anything she finds. of course they will look hungry when she found them they were gone for 2 weeks.
 
Well ive called everyone i could think of today..and pretty much been told Im going to upset her. I just want my birds back. Theyre not dogs..they didnt maul children or kill cats. I think Ive spoken to enough people today to get some kind of ball rolling. Im pretty sure her boss is the cheif of police..im afraid to call him up..who wants to deal with the police..not me..lol. I figure I will see what the people I spoke with today can do..hopefully one of them can explain the laws to her ..ie: i dont need a permit or license to keep peafowl ..not india blue ..nor do i need any permits for my cochins..silkies or guineas ..that she has no idea what they even are.

i will be sure to follow up when i get some news

You call some TV stations. You take one with you to her dog pound and you get your birds back.
Get a copy of your city/town/rural whatever ordinances. Call a lawyer if you have to. Send her a letter with a copy of the ordinances highlighted. End your letter with "Please be advised" (my MIL has always told me to use this...it works too).
I dont think it will take too much work on the lawyers part to get them back. But hey, sue the dumbass if you can!! Sorry for the 'fowl' language. Ppl like this piss me off, and our EX animal control, and unfortunately my neighbor 4 houses down, STILL thinks he is animal control....and when he was just a dog catcher, he acted like he was a cop.
Weve called the cops on him multiple times just because he wont stop harassing us and we have some trespassing thingy filed against him/delivered to him. And yep, I called the chief of police on him.
