Massachusetts Dog officer holding my Birds hostage !!

Go to your police station and file a report on the theft of your birds. If she is keeping them herself, rather than keeping them in the local pound, then she is doing this as a private citizen, not in her official capacity. Provide all identifying information (it would be SO awesome if they have permanent legbands or tatoos) on your birds.

As for inspectors, unless she has gone through your town animal control department or your county animal control department (whether it is hers or not) or the state game & fish department, and the inspectors belong to one of those agencies who DO have jurisdiction over your property, then absolutely refuse them permission to enter. If they show up and insist, or say they have a warrant, call your police. Treat is and report it as a home invasion. Specifically state that you doubt the validity of their warrant. (As I said, make sure that anyone serving you is indeed out of their jurisdiction; you do not want a failure to comply charge filed against you.) Be respectful, but firm.

You probably want to post No Trespassing signs, and keep your birds in the barn; lock the barn doors. I hope it does not come to intimidation, but better to be prepared than not.
 
Yeah i wouldnt care one bit if she was upset. I dont believe you have to let her on your property to get them back, just keep on badgering her and let her know all the people you have called thats on your side. I would be making a sign right now "Inspectors shot on site"

I think once you report them as stolen to HER boss, the chief of police, I would get the press involved.........................................

Yeah, I think she just wants the birds for herself. Shouldn't this officer be out doing her job (which involves DOGS) instead of mesing around with someones birds? What are our tax dollars paying for anyway!

Reminds me of a local policewoman who kept harassing the kids in our old neighborhood for riding dirt-bikes, four-wheelers and go-carts on my son's friend's own property! Would she have rather that they were running the streets, breaking into people's houses------I just wish some cops would do the job they were hired to do, and not spend their time harassing law-abiding citizens.

I agree with filing a stolen property report with your local police. You could list the birds' value as over $500 and then it becomes a felony. After you file the report call the chief of police in charge of the rogue AC officer and let him/her know that they have stolen property in their possession and you would like it returned and you will dismiss the felony report. If the chief gets snotty then inform him/her that transporting stolen property over state lines is a federal crime and you will be contacting the feds. Sometimes you need to put a little fire under foot to get a few things done. Good Luck.
 
Well i thought id post an update. After about 60 phone calls on my part I finally got somewhere. Yesterday I called the Town manager , the police Dept who happens to be her supervisor & eventually got 2 calls from the persona who she had origionally said she was bringing up to confiscate all of my birds. He said my birds will be able to be picked up over the next few days :)..but since they left the property..they will require testing ..fine with me becuase my birds dont have pollerum or typhoid lol. Boy..that dog officer must have though she was dealing with idiots & thought her intimidation & idle threats would get her somewhere...NOT.
I explained to each of the people I spoke with, I turned those eggs several times a day & sprayed them & hatched them & cared for them as babies..that they might think of them as just birds..but to me they were like dogs..and if they had dogs they would understand..that all i wanted was to get them back home.
